Selva Kumar Files Age Discrimination Lawsuit Against Tata Consultancy Services

Las Vegan Selva Kumar, 48, has filed an age discrimination lawsuit against his former employer, India-based IT conglomerate Tata Consultancy Services (TCS). Initially, Kumar filed a charge with the Equal Employment Opportunity Commission (EEOC). In September 2024, the EEOC issued a notice of right to sue, stating Kumar has the right to institute a civil action against his former employer, TCS.
Per the lawsuit, TCS hired Kumar as a full-time staff, an Associate Consultant for Information Technology Financial Consulting in May 2018, and over a period of 6 years, he worked in 8 cities across six states nationwide. At the time of termination, Kumar worked at TCS’s Houston office, which has over five hundred employees. As per Kumar, he was well qualified for his job position and performed his job description in an excellent manner, as indicated in his achievements, commendations, and awards.
On October 13, 2023, Kumar’s services were terminated together with more than 50 other employees. It is alleged that Defendant TCS failed to give the period of Notice required under the relevant provisions of the Worker Adjustment and Retraining Notification Act of 1988 (WARN Act), which requires employers to provide at least 60 days advance written Notice of a mass layoff.
It is alleged that terminating Kumar, the Defendant TCS, was influenced wholly by his age, and the decision to terminate him was based solely on his age. Kumar’s lawsuit claims that TCS did not even give one day’s Notice before termination; the human resources manager called the plaintiff on the phone and savagely said, “Today is your last day.”
Kumar believes some employees below 40 years old with equal or inferior qualifications, skills, and experience than the plaintiff were not terminated. Kumar is seeking to recover pay equivalent to his regular earnings of $10,555 per month from the date of termination until the date of judgment. Additionally, Kumar claims he has suffered general damages for distress, humiliation, sleepless nights, pain, and suffering and is seeking $300,000 in compensation.
