Las Vegas spine surgeon Dr. Jaswinder Grover has filed a lawsuit against Certain Underwriters at Lloyd’s of London, seeking $40 million under an insurance policy. The original complaint was filed in Clark County District Court and included a demand for a jury trial. The case has since been removed to the United States District Court for further proceedings.

Per the filed complaint Dr. Grover applied for an insurance policy which was accepted and received a policy of insurance from Lloyd’s. The policy was effective for five years from March 30^th 2017 through March 29^th 2022. The Policy provides for a lump-sum benefit of $40 Million upon the satisfaction of specified conditions.

Dr. Grover filed a claim with Lloyd’s for payment pursuant to the Policy. Defendant Lloyd’s retained an Independent Medical Examiner (“IME”) to evaluate Dr. Grover’s diagnosis pursuant to the Policy. It is alleged that despite clear and consistent medical evidence, Defendant Lloyd’s failed and refused to approve Dr. Grover’s claim.

Per the filings, Dr. Grover claims to be permanently and totally disabled from his occupation as a result of a spinal condition, and alleges that Underwriters have wrongfully failed to approve his claim for a $40,000,000 lump sum benefit for Permanent Total Disability under an individual disability insurance policy. The Policy contains a binding arbitration clause which states – as part of the proof of Permanent Total Disability there must be included a certification from a physician that the Insured Person has suffered Permanent Total Disability as defined in the Certificate.

The lawsuit alleges claims for breach of contract, breach of the implied covenant of good faith and fair dealing, and violations of Nevada’s Unfair Claims Practices Act.
