Death of a Patient – Medical Malpractice Lawsuit Filed

It is alleged that the Defendants R.D. Prabhu-Lata K. Shete , M.D’.s Ltd. d/b/a Red Rock Medical Group, and Leslie Rowens, PA-C undertook to treat and care for Ms. Stanaitis and implicitly agreed to exercise and use a reasonable degree of care in the diagnosis, care and treatment of her.

In a lawsuit filed in the Clark County District Court, it is alleged that prior to her death, Ms Stanaitis was a patient of Red Rock, where Red Rock, PA-C Rowens and her supervising physician prescribed Ms. Stanaitis numerous pain medications including, but not limited to – morphine; hydromorphone; diazepam; and carisoprodol.  Ms. Stanaitis took the aforementioned prescriptions as directed by the Defendants. 

In a court filing, it is alleged that on October 13, 2014, Ms. Stanaitis died as a result of the consumption of the aforementioned prescription drugs.  Additionally, that following Ms. Stanaitis’ death, the Plaintiff – Andrea Herbert, as a special administrator of the Estate of Rita Stanaitis, attempted to retrieve Ms. Stanaitis’ medical records from Red Rock on multiple occasions only to be told that the records were lost.

It is alleged that Defendants, and all of them, were negligent in their actions leading to the wrongful death of Ms. Stanaitis in the following ways including, but not limited to:

Red Rock, PA-C Rowens and her supervising physician failed at their duty to provide competent care and to warn Ms. Stanaitis of the dangers and sedative impact of the aforementioned medications can have alone, but also when combined with each other can cause a much more powerful effect.

Red Rock, PA-C Rowens and her supervising physician breached their duty to Ms. Stanaitis by combining these aforementioned medications which caused central nervous system depression, sedations, cessation of breathing and ultimately Ms. Stanaitis’ death.

Red Rock, PA-C Rowens and her supervising physician also prescribed Ms. Stanaitis carisoprodol which is a muscle relaxer and central nervous system depressant or sedating medicine which contributed to, when combined with the other medications, Ms. Stanaitis’ death.

Red Rock, PA-C Rowens and her supervising physician failed to properly maintain and/or “lost” Ms. Stanaitis’ medical records.
