Dr. Desai’s Federal Health Care Fraud Trial Date Moved to April 2015

Federal Judge moved Dr. Desai’s health care fraud trial date to April 2015. In a strange twist to Dr. Desai’s ongoing legal issues, the counsel for Dr. Desai is filing a request for a Gujarati interpreter.
The parties concerned, defense counsel and prosecutors, have agreed to a resolution of the case and are near completion of the Plea Memorandum. The plea negotiation process has been slow and deliberate with extra time being necessary for counsel for Desai to communicate with Desai who is incarcerated at the Northern Nevada Correctional Center in Carson City, Nevada.
In July 2013, the District Court jury convicted Dr. Desai on 27 criminal counts. The judge sentenced Dr. Desai to life in prison with a possibility of parole after 18 years of serving jail time. Dr. Desai’s counsel Richard Wright met with Desai as recently as January 8, 2015 at the Northern Nevada Correctional Center and Desai has agreed to the plea agreement terms. Additional meetings with Desai are necessary for the execution of the plea agreement.
Once the parties have all signed the Plea Agreement and notified the Court, counsel for Desai will be filing a Request for Accommodations for Plea Process suggesting the use of a Gujarati interpreter to enable Desai to converse in his native language, along with other suggestions.
The additional time requested by Dr. Desai’s legal team is to allow counsel for the government and the defendant sufficient time to effectively and thoroughly review and discuss negotiations.
The trial date in this matter, which was January 2015, was vacated and reset to Tuesday, April 28th, 2015.
