U. B. Kothari is charged with operating a motor vehicle under the influence of alcohol within the boundaries of the Hoover Dam project area. Kothari is accused of driving a Nissan Rogue under the influence of alcohol to a degree that rendered Kothari incapable of safe operation of the vehicle.

As per the complaint, Kothari had difficulty finding his vehicle and was later observed operating his SUV after being told not to drive because he was intoxicated. Kothari crossed the double-yellow centerline into the opposite lane of traffic. As per the report, the ranger noticed Kothari displayed bloodshot eyes and slurred speech and denied consuming any alcohol. 

When asked to exit the vehicle, Kothari began to yell at the officers, claiming they were racist and going to kill him as they were white. Kothari failed the field sobriety test and other physical tests like walk & turn, one-leg test, etc. The other occupants in the car included an adult female and an older woman in the back seat with two unrestrained children.
