A. Wadia Pleads Guilty to Possession of Controlled Substance with Intent to Sell

A. Wadia has pleaded guilty to a charge of a possession of a controlled substance with an intent to sell the same. The plea agreement includes that State will not oppose gross misdemeanor treatment and Wadia will get the credit for time served. The agreement calls for the forfeiture of any and all property, monies, and/or weapons seized by the Henderson Police Department.
As a consequence of Wadia’s plea of guilty, the court may elect to treat this offense as a felony or as a gross misdemeanor. If the court treat this offense as a felony, Wadia may be imprisoned for a minimum term of not less than one year and a maximum term of not more than four years. In addition, Wadia may be fined up to $5,000. However, if the court treat this offense as a misdemeanor, Wadia will be imprisoned for a period of not more than 364 days. Additionally, Wadia may be fined up to $2,000.
